适用范围 | Scope: 本指南适用于通过 UMInk 平台提交的数字版权侵权举报，符合欧盟《通用数据保护条例》(GDPR) 和英国《版权、设计与专利法》(Copyright, Designs and Patents Act 1988) 的要求。

📌 举报流程 / Submission Process

1. 发送举报邮件 / Send a Notification Email

请通过以下方式提交正式举报请求：

Subject: DMCA Notice: [简要描述侵权内容 | Briefly describe the infringing content]
Body: 包含以下信息（中英文均可）：

✅ 必须包含的声明 / Required Information

类别 Category 内容 Content
1. 版权声明 Copyright Claim 声明您是被侵权作品的合法权利人或授权代表。 State that you are the legal owner of the copyrighted work or authorized representative.
2. 被侵权作品信息 Infringed Work Details 提供被侵权作品的标题、作者、发布日期、原始文件链接或证据（如版权注册证书、原创性证明）。 Provide the title, author, publication date, original file link, or evidence (e.g., copyright registration, proof of originality).
3. 侵权内容位置 Location of Infringing Content 提供侵权内容的完整 URL（如：https://cloud.um.ink/xxx/xxx）及具体侵权内容描述（如文件名、片段等）。 Provide the full URL of the infringing content (e.g., https://cloud.um.ink/xxx/xxx) and a detailed description (e.g., file name, excerpt).
4. 权利人身份证明 Rights Holder Verification 附上权利人身份证明（如公司营业执照、个人身份证件复印件）及联系方式（电话、地址）。 Attach proof of rights holder identity (e.g., business license, ID copy) and contact information (phone, address).
5. 签名 Signature 手写签名或电子签名（需注明日期）。 Handwritten or electronic signature (with date).

2. 平台处理流程 / Platform Handling Process

🛡️ 步骤 1: 内容核查 | Step 1: Content Verification

  • 收到举报后，平台将在 3 个工作日内 完成初步核查。
  • 若确认侵权成立，将根据以下步骤处理：

🚫 步骤 2: 移除侵权内容 | Step 2: Remove Infringing Content

  • 删除侵权内容及关联分享链接。
  • 通知上传者其内容已被移除（依据 GDPR 第 17 条“被遗忘权”）。

📬 步骤 3: 通知上传者 | Step 3: Notify Uploader

  • 上传者可在 14 天内 提交申诉（需提供反证，如原创性证明或授权文件）。
  • 申诉成功则恢复内容，否则永久删除。

📋 步骤 4: 向举报人反馈 | Step 4: Feedback to Complainant

  • 通过邮件告知举报人处理结果及依据的法律条款。

🇪🇺 欧盟 GDPR 与英国法律

  • GDPR 第 17 条：用户享有“被遗忘权”，平台需在合理期限内删除非法内容。
  • 英国《版权法》第 97 条：权利人可要求平台移除未经授权的侵权内容。
  • 《数字市场、竞争与消费者法案 2024》：要求平台建立透明的侵权处理机制。

📜 DMCA 合规性

  • 本流程符合美国《数字千年版权法案》(DMCA) 第 512 条“安全港”条款，确保平台在合规操作下不承担侵权责任。
