DMCA Copyright Infringement Notice Guide

Scope: This guide applies to copyright infringement notices submitted through the UMInk platform, in compliance with the EU GDPR and the UK Copyright, Designs and Patents Act 1988.
📌 Submission Process
1. Send a Notification Email
Submit a formal notice via:

Subject: DMCA Notice: [Briefly describe the infringing content]
Body: Must include the following information:

| 2. Infringed Work Details | Provide the title, author, publication date, original file link, or evidence (e.g., copyright registration, proof of originality). |
| 3. Location of Infringing Content | Provide the full URL of the infringing content (e.g., https://cloud.um.ink/xxx/xxx) and a detailed description (e.g., file name, excerpt). |
| 4. Rights Holder Verification | Attach proof of rights holder identity (e.g., business license, ID copy) and contact information (phone, address). |
| 5. Signature | Handwritten or electronic signature (with date). |
2. Platform Handling Process
🛡️ Step 1: Content Verification
- Within 3 business days, the platform will conduct a preliminary review.
- If infringement is confirmed, the following steps will apply:
🚫 Step 2: Remove Infringing Content
- Remove infringing content and related links.
- Notify the uploader that their content has been removed (in line with GDPR Article 17, “Right to Erasure”).
📬 Step 3: Notify Uploader
- The uploader may submit a counter-notice within 14 days (with supporting evidence such as proof of originality or license).
- If the counter-notice succeeds, the content will be reinstated; otherwise, it will be permanently deleted.
📋 Step 4: Feedback to Complainant
- The complainant will be informed of the result and the legal basis for the action.

🇪🇺 EU GDPR & UK Law
- GDPR Article 17: Users have the “Right to Erasure”; platforms must delete unlawful content within a reasonable timeframe.
- UK Copyright Act, Section 97: Rights holders may require removal of unauthorized infringing content.
- Digital Markets, Competition and Consumers Act 2024: Requires platforms to establish transparent infringement handling procedures.
📜 DMCA Compliance
- This process complies with Section 512 of the US Digital Millennium Copyright Act (DMCA) “Safe Harbor” provision, ensuring the platform is not liable if it responds properly to notices.
